Two different risk profiles, one first step

For a commercial or retail fitout: the pre-lease check is the highest-value thing we do

Before you sign, three things need confirming: that the zoning permits your intended use at all, that the premises has an existing approved use and what it is, and whether any prior condition of consent restricts hours, capacity or ventilation in a way that affects you. We have seen operators sign a lease for a space that could not be used as a food premises without works the landlord would not fund - that conversation is much better to have before the lease than after.

A cafe, restaurant or takeaway also needs to satisfy the environmental health and food safety framework alongside the planning approval - construction requirements, mechanical exhaust, grease arrestor, waste storage, and food business notification. EHUP holds both capabilities, so the health requirements are designed into the fitout at the same time as the planning documentation, rather than handed back to you halfway through.

For a light industrial project: feasibility comes before documentation

Because the capital at risk is larger, the order of work is deliberately inverted from a standard residential job: instead of documenting first and discovering constraints later, we establish permissibility and the achievable development envelope first, in writing, and only then commit to a documentation programme. That written feasibility is also the document you can hand to a financier or a joint venture partner.

A use can be permissible with consent in the zone and still be undeliverable on the particular site

  • because the access geometry will not accept the vehicle types the use generates, because the parking rate cannot be met, or because a contamination history requires remediation that changes the economics. Permissibility is a half-hour check. Feasibility is the work that actually protects you.

The report stack, and who owns the gaps

On larger commercial and industrial projects, the traffic consultant's assumed vehicle movements have to match the acoustic consultant's noise model, which has to match the operational description in the planning report, which has to match what the architect drew. When nobody owns those interfaces, council finds the contradiction and issues a request for further information. We hold that coordination role across every report the project needs.

Frequently asked questions

I have a lease deadline. Can this be fast-tracked?

Where the premises and the proposed use satisfy the Codes SEPP in full, a Complying Development Certificate can be issued in as little as two to three weeks. Not every fitout qualifies. Tell us your opening date at the first call and we will tell you honestly whether it is achievable.

Should I check approval before I sign the lease or exchange contracts?

Yes - this is the single most valuable thing on this page. If a premises has an approved use that does not cover what you intend, or a site cannot physically accommodate what you plan, you can end up paying rent or holding capital on something you cannot legally use. A check takes a day or two for a fitout, one to two weeks for a development site.

Does changing from a shop to a cafe need approval?

Almost always yes - food premises carry requirements a general retail approval does not, covering ventilation, grease management, waste and food preparation areas. It also triggers environmental health and food safety requirements, which we handle in the same scope rather than referring out.

Can you give me a feasibility read before I buy an industrial site?

Yes, and we recommend it. A pre-purchase feasibility covers permissibility, the development envelope the controls allow, obvious site constraints, and the likely specialist report requirements - the cheapest de-risking available on an industrial acquisition.

Which specialist reports will my project need?

For a fitout, commonly a waste management plan and, depending on the use, an acoustic or traffic report. For an industrial development, commonly traffic and parking, stormwater, an acoustic assessment, a preliminary contamination investigation and a geotechnical report. We scope this precisely for your project rather than listing everything by default.

Do you coordinate the specialists or do I engage them separately?

We coordinate them under one scope. That is the main reason clients on larger projects come to us - one point of contact, one programme, and someone whose job it is to resolve the contradictions between two consultants' findings before council does it for them.

Change of Use

A change of use application is needed when the building stays the same but what happens inside it changes - retail to cafe, warehouse to gym, office to medical suite.
