A residential flat building is an apartment building, generally assessed against both your council's LEP and DCP and the Apartment Design Guide, the design-quality framework that grew out of the SEPP 65 principles. That framework addresses solar access, natural cross-ventilation, deep soil, communal open space and apartment size and layout, alongside the usual planning controls. This scale of development always requires a development application, and larger proposals may be referred to a design review panel before determination.

Apartments are assessed twice, in effect

A residential flat building has to satisfy the ordinary planning controls in the LEP and DCP, and separately has to satisfy the Apartment Design Guide's design-quality benchmarks. Both frameworks are applied together, and a scheme that passes one but not the other does not get approved.

The benchmarks that shape the building, not just decorate it

Solar access and natural cross-ventilation targets affect floor plate depth and apartment orientation. Deep soil and communal open space requirements affect how much of the site can be built on. Apartment size and layout benchmarks affect unit mix. These are design inputs, not compliance checks applied after the fact - which is why we test a concept against them before the design team commits to a building form.

What is the Apartment Design Guide and does it always apply?

It is the design-quality framework that grew out of the SEPP 65 principles, applying to residential flat buildings and setting benchmarks for things like solar access, natural cross-ventilation, apartment size, and communal open space. It applies alongside the standard LEP and DCP controls, and generally applies to this scale of development across NSW.

Will my apartment building need to go before a design review panel?

It depends on scale and your council's policy - some councils refer all residential flat building proposals above a certain size to a design review panel, others reserve it for larger or more sensitive sites. We confirm this early since it affects both timeframe and the level of design documentation needed at lodgement.

Why do parking and waste come up so often as issues?

At apartment building scale, car parking numbers, waste collection vehicle access, and loading dock location interact directly with basement design, ground floor activation, and traffic engineering. Getting these wrong late in design is expensive to fix, which is why we bring them into the concept stage rather than leaving them to a construction-certificate afterthought.

How much does cross-ventilation actually constrain the floor plate?

Meaningfully, on many sites. Natural cross-ventilation benchmarks favour narrower floor plates and particular apartment orientations, which can reduce the achievable yield compared to a deep, single-aspect floor plate. It is one of the first things worth testing before committing to a building envelope.

Shop Top Housing / Mixed Use

Shop top housing is dwellings built above ground-floor retail or commercial premises in a mixed-use zone, and it usually requires a full development application.

Low & Mid-Rise Housing

The Low and Mid-Rise Housing reforms allow terraces, manor houses, and residential flat buildings of two to six storeys on sites that were previously limited to houses or duplexes, where the site sits within a set walking distance of a train station or a nominated town centre in an eligible council area.
