Website Terms and Conditions of Use

These terms and conditions of use were last updated in September 2026.

1. About the Website

Welcome to www.ehup.com.au (the “Website”). The Website provides information about, and allows you to enquire regarding and purchase, town planning, environmental health, food safety, building certification, and development approval consultancy services, including our AI Planning Reports (together, the “Services”), offered by the operator of the Website.

The Website is operated by Ehup Pty Ltd (ABN 54 665 300 372), trading as EHUP Consultancy (“EHUP Consultancy”, “we”, “us” or “our”). Access to and use of the Website, or any of its associated products or Services, is provided by EHUP Consultancy. Please read these terms and conditions (the “Terms”) carefully. By using, browsing and/or reading the Website, you signify that you have read, understood, and agree to be bound by the Terms. If you do not agree with the Terms, you must cease using the Website immediately.

EHUP Consultancy reserves the right to review and change any of the Terms by updating this page at its sole discretion. When we update the Terms, we will use reasonable endeavours to notify you. Any changes to the Terms take effect immediately from the date of publication. We recommend you keep a copy of the Terms for your records.

2. Acceptance of the Terms

You accept the Terms by using the Website, submitting an enquiry or contact form, creating an account, purchasing an AI Planning Report, or engaging us to provide Services, or by clicking to accept the Terms where that option is made available to you. By submitting a form or making a purchase on the Website, you consent to being contacted by EHUP Consultancy about your enquiry or order and, unless you opt out, to receive occasional related marketing communications from us.

3. Accounts

You do not need an account to purchase an AI Planning Report — you may check out as a guest. However, you may choose to register for an account to, for example, view your order history or access previously purchased reports.

If you create an account, you agree to:

  • provide accurate, current and complete information;
  • keep your login credentials confidential and not share them with any other person;
  • notify us immediately at ehupconsultancy@gmail.com of any unauthorised use of your account or any other breach of security; and
  • accept responsibility for all activity that occurs under your account, except where caused by our fault.

We may suspend or close your account at our discretion if we reasonably believe it has been used in breach of these Terms or for any unlawful purpose.

4. The Services

The Website provides general information about our consultancy Services in town planning, environmental health, food safety, building certification and development approval matters, allows you to submit enquiries or request a consultation, and allows you to purchase certain digital products, including AI Planning Reports, directly online.

To submit an enquiry, request a consultation, or purchase a product, you may be asked to provide personal information, including:

  • name;
  • email address;
  • telephone number;
  • property address or project location;
  • a brief description of your project or enquiry; and
  • payment details (processed by our third-party payment processors as described in clause 6).

You warrant that any information you provide to us is accurate, correct and up to date, to the best of your knowledge, and you acknowledge that the accuracy of any AI Planning Report you purchase depends on the accuracy of the information and property details you provide.

Submitting a general enquiry through the Website does not, by itself, create a contract for the provision of consultancy Services. A formal engagement for our advisory consultancy Services (as opposed to an AI Planning Report purchased instantly online) will generally arise once we have agreed to act for you, following a separate written proposal, fee agreement, or letter of engagement.

Nothing on the Website constitutes a guarantee of any particular planning, certification, or regulatory outcome (including approval by any Council, certifier, or government authority). Outcomes depend on the specific facts of each matter and the decisions of the relevant authority.

All features of the Website are subject to change, development or discontinuation at any time.

5. AI Planning Reports (where available)

EHUP Consultancy offers instant, automatically generated planning reports (“AI Planning Reports”) which are produced using artificial intelligence and/or automated tools based on the property address and information you provide, together with publicly available planning and mapping data.

Nature of the report. An AI Planning Report is a general, automated information product. It is generated without individualised review by a qualified town planner unless we expressly state otherwise for a particular product, and it does not constitute formal town planning advice, a professional opinion, a certification, or a substitute for a full planning assessment, pre-lodgment advice, or engagement of our advisory Services.

No guarantee of accuracy or outcome. While we aim to use reliable data sources, planning controls, mapping layers, and Council records can change, contain errors, or be interpreted differently by different authorities. AI-generated content may occasionally be incomplete, out of date, or contain inaccuracies. To the maximum extent permitted by law, EHUP Consultancy does not warrant the completeness, accuracy or currency of an AI Planning Report, and you should not rely on it as the sole basis for a development, purchase, or investment decision without independent verification or, where appropriate, engaging us or another qualified professional for a full assessment.

Instant delivery and refunds. AI Planning Reports are generated and made available (including for download) instantly or shortly after payment is confirmed. Because the product is digital and delivered immediately, once a report has been generated and made available to you, you are not entitled to a refund or credit except:

  • where required by the Australian Consumer Law (for example, where the report was not generated due to a fault on our part, was based on the wrong property due to our error, or a technical failure prevented delivery); or
  • where we determine, at our discretion, that a refund is appropriate.

Downloads. Where an AI Planning Report is provided as a downloadable file (for example, a PDF), you are responsible for saving your own copy. We may, but are not obligated to, retain a copy accessible via your account (if you have one) for a limited period, and we recommend you download and retain your own copy at the time of purchase.

Use of the report. You may use an AI Planning Report for your own personal or internal business reference in connection with the relevant property. You must not resell, sublicense, or represent the report as independent professional advice from a third party, or as a certified planning assessment, without our prior written consent.

We may update, retire, or change the scope, format, or data sources of AI Planning Reports at any time, and may correct or withdraw a report if we identify a material error, without liability for any resulting loss beyond a refund of the price paid for that report (where applicable under clause 5(d)).

6. Online Payments (if available)

Where you purchase an AI Planning Report or other product via the Website, prices are displayed in Australian Dollars and are payable in full at the time of purchase, using the payment method(s) made available at checkout, which may include credit/debit card, PayPal, Stripe, or other payment methods we may introduce from time to time.

All online payments are processed by third-party payment processors (which may include Stripe, PayPal, and/or other providers). We do not store your full card details on our systems. Your payment information is collected and processed directly by the relevant payment processor in accordance with their own terms of service and privacy policy, which we encourage you to review before making a payment.

By making a payment, you warrant that you are authorised to use the payment method provided.

If a payment fails, is disputed, charged back, or reversed, we may suspend delivery or access to the relevant AI Planning Report or other product, and may take reasonable steps to recover any amount owing, including via debt collection.

We are not responsible for any delay, failure, error, or additional fees (such as currency conversion or bank fees) arising from the processing of a payment by a third-party payment processor, your bank, or card issuer.

We may change the price of any product at any time, but a price change will not affect an order you have already paid for.

Applicable Australian taxes (including GST, where relevant) will be included or added at checkout as required by law.

7. Your obligations as a user

As a user of the Website, you agree that you will:

  • use the Website only for lawful purposes and in accordance with the Terms;
  • not impersonate any person or misrepresent your affiliation with any person or entity when submitting an enquiry or making a purchase;
  • not use the Website to transmit, distribute or store material that is unlawful, defamatory, harassing, or infringes the rights of any third party;
  • not attempt to gain unauthorised access to any part of the Website, its servers, any user account, or any systems or networks connected to the Website;
  • not use any automated means (including bots, scrapers or data-mining tools) to access, collect data from, or interact with the Website without our prior written consent;
  • not use the Website to collect contact details of any person for the purpose of sending unsolicited communications;
  • not attempt to circumvent, exploit, or misuse the AI Planning Report ordering or payment process (for example, by using fraudulent payment details); and
  • comply with all applicable laws, including the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law), the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth), and any applicable planning, environmental, food safety or building legislation relevant to your enquiry.

8. Enquiries, Quotes and Engagement of Advisory Services

Any indicative pricing, fee estimate or scope of work referred to on the Website in relation to our advisory consultancy Services (as distinct from the fixed, published price of an AI Planning Report) is general in nature and provided for guidance only, and does not constitute a binding quote.

A binding fee proposal for advisory Services will only be provided following our review of your specific project details, and any engagement of those Services will be subject to a separate written agreement or letter of engagement between you and EHUP Consultancy, which will set out the applicable fees, payment terms, and scope of Services.

This clause 8 does not apply to AI Planning Reports, which are governed by clauses 5 and 6.

The Website and all of its content (including but not limited to text, graphics, logos, images, videos, Website code, design elements, interactive features, and the format and template of AI Planning Reports) are subject to copyright and are owned or controlled by EHUP Consultancy or its licensors, protected under the laws of Australia and applicable international treaties.

All trademarks, service marks, business names and logos displayed on the Website are owned by, or licensed to, EHUP Consultancy. We grant you a limited, non-exclusive, revocable licence to:

  • access and view the Website for your own personal, non-commercial use;
  • copy and store pages of the Website in your device’s cache memory;
  • print pages of the Website for your own personal, non-commercial reference; and
  • where purchased, download and retain your own copy of an AI Planning Report for the personal or internal business use described in clause 5(f).

You must not, without our prior written permission, reproduce, republish, upload, transmit, distribute, adapt, resell or commercially exploit any content from the Website, or any AI Planning Report, for any purpose beyond that described in clause 5(f).

Where you submit any content to us via the Website (for example, project descriptions, photos, or documents accompanying an enquiry or order), you grant EHUP Consultancy a non-exclusive licence to use that content solely for the purpose of responding to your enquiry and/or providing the Services or AI Planning Report you have requested.

10. Privacy Policy

EHUP Consultancy takes your privacy seriously. Any personal information (including payment-related information collected on our behalf by our payment processors) you provide through the Website is collected, held, used and disclosed in accordance with our Privacy Policy, available on the Website, and the Privacy Act 1988 (Cth).

11. General Disclaimer

Nothing in the Terms limits or excludes any guarantee, warranty, representation or condition implied or imposed by law, including the Australian Consumer Law, which cannot lawfully be excluded.

Subject to clause 11(a), and to the extent permitted by law:

  • all terms, guarantees, warranties, representations or conditions not expressly stated in these Terms are excluded; and
  • EHUP Consultancy will not be liable for any indirect or consequential loss, loss of profit, loss of opportunity, or damage to goodwill arising out of or in connection with your use of the Website or any AI Planning Report, whether in contract, tort (including negligence), equity, under statute or otherwise.

The Website, its content, and any AI Planning Report are provided on an “as is” and “as available” basis. General information published on the Website, and the content of any AI Planning Report, is provided for general informational purposes only, does not constitute professional advice, and should not be relied upon as a substitute for a formal engagement with us or independent professional, legal or financial advice specific to your circumstances.

We do not warrant that the Website, our payment processing, or the generation or delivery of any AI Planning Report will be uninterrupted, error-free, or free of viruses or other harmful components, and we are not liable for any loss or damage arising from your use of, or inability to use, the Website or any AI Planning Report, or from any errors, omissions or delays in its content.

You acknowledge that planning, environmental, certification and food safety outcomes are ultimately determined by the relevant Council, certifier, authority or regulator, and neither EHUP Consultancy nor any AI Planning Report guarantees any particular outcome, approval, timeframe or result.

12. Limitation of Liability

To the maximum extent permitted by law, EHUP Consultancy’s total liability arising out of or in connection with your use of the Website or any AI Planning Report will not exceed, at our election, the resupply of the relevant Website information service or AI Planning Report, or the amount you paid for that AI Planning Report.

To the maximum extent permitted by law, EHUP Consultancy, its directors, employees, agents and contractors will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages arising from your use of the Website or reliance on an AI Planning Report.

All information on the Website, and every AI Planning Report, is provided to assist you generally and is not intended to replace professional planning, environmental, legal, or financial advice tailored to your specific project.

13. Termination

EHUP Consultancy may, at its discretion, suspend or restrict your access to the Website or your account at any time, without notice, if we reasonably believe you have breached these Terms or applicable law.

These Terms continue to apply to your prior use of the Website, your account, and any AI Planning Report purchased, even after your access is suspended, restricted or ceases.

The Website may contain links to third-party websites, and uses third-party payment processors as described in clause 6. EHUP Consultancy does not endorse and is not responsible for the content, accuracy, practices, or terms of any linked third-party website or payment processor.

15. Indemnity

You agree to indemnify EHUP Consultancy, its directors, employees, agents and contractors from and against any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or in connection with:

  • your breach of these Terms;
  • your misuse of the Website, your account, or an AI Planning Report;
  • your use of fraudulent or unauthorised payment details; or
  • any content you submit to us via the Website that infringes the rights of a third party or is inaccurate or misleading.

16. Venue and Jurisdiction

You agree that the exclusive venue for resolving any dispute arising out of or in relation to the Website shall be the courts of New South Wales, Australia.

17. Governing Law

These Terms are governed by the laws of New South Wales, Australia, without reference to conflict of law principles.

18. Age

By using the Website to submit an enquiry, create an account, or purchase an AI Planning Report, you affirm that you are 18 years or over, or that you have the consent of a parent or legal guardian.

19. Severance

If any part of these Terms is found to be void or unenforceable by a court of competent jurisdiction, that part shall be severed, and the remainder of the Terms shall continue in full force and effect.
