Can I run a nail salon from home in Sydney?
Summary: usually yes, with approval. Once clients come to your home you generally need a planning approval from council. And if any service you offer breaks the skin, the premises also has to be registered separately. Most people only find out about the second one too late.
This is one of the most common questions we get, and the answer has two halves that people almost never hear together.
The planning half
The moment clients come to your house, the business is generally no longer "home occupation" (which is often exempt) and becomes "home business" - which normally needs council approval.
Council is assessing whether a beauty service is an acceptable use of a residential address. In practice that means:
- How many clients per day, and when they arrive
- Where they park - this is the number one source of neighbour complaints
- Hours of operation
- Noise, including any ventilation or equipment
- How much of the house is given over to the business
- Signage
- Waste
None of these are trick questions. The applications that get approved are the ones with a realistic, specific operating description: "one to three clients per day, 9am to 5pm, off-street parking in the driveway, no signage" is approvable. A vague description leaves council to assume the worst case.
The health half - the part nobody tells you
The health requirements cover sterilisation and disinfection of reusable instruments, use of single-use items, safe disposal of sharps and contaminated waste, a hand-washing basin in the treatment area, cleanable surfaces, and separation of the treatment area from domestic activity.
For a home salon these are usually achievable with modest changes to one room. The problem is discovering them during an inspection rather than designing for them.
Which of your services matter
The service list decides the requirements, not the business name.
Generally not skin penetration: manicures, pedicures, gel and acrylic nails, standard waxing, threading, lash extensions and lifts, facials, makeup, spray tanning.
Generally skin penetration: cosmetic tattooing, microblading, microneedling and derma rolling, dermal and ear piercing, and some advanced cosmetic treatments.
If your list includes anything in the second group, the premises needs to be registered. If you are not sure which group a specific treatment falls into, that is exactly the sort of thing to ask about
- the boundary cases are genuinely unclear and the consequence of guessing wrong is enforcement.
If you are already operating
Very common, and almost never fatal. Councils deal with a steady stream of home businesses becoming compliant, and the outcome for someone who comes forward is very different from the outcome for someone found after a complaint.
The worst option is doing nothing. If you have had a letter, a phone call or a visit, get advice before you write back.

Frequently asked questions
What if I only see two or three clients a week?
Once clients visit the premises you are generally past the home occupation tier and into home business, which usually needs approval regardless of volume. Some councils set a client-number threshold. It is worth a quick check rather than an assumption.
Does gel or acrylic count as skin penetration?
Standard manicures, gel and acrylic application generally do not. Cosmetic tattooing, microblading, microneedling and dermal piercing do. The test is whether the procedure penetrates or is intended to penetrate the skin, so it turns on your actual service list.
A neighbour complained. What happens now?
Council will usually investigate the use rather than the complaint itself. Having an approval, or having an application already lodged, changes that outcome substantially. Get advice before responding to council in writing.
